Terms & Conditions

2.1 Monthly subscription prices: All prices are exclusive of VAT and are based on monthly subscription payments with a minimum 12-month commitment.

2.2 Price adjustment: Dreamstate reserves the right to adjust prices once annually in accordance with:

• Statistics Denmark's net price index
• Significant increases in hosting and server costs
• Changes in exchange rates for international services
• New legal requirements or fees

Customers will receive written notice of price changes at least 30 days before implementation.

2.3 Pricing: The price of 499 DKK/month is binding throughout the entire first contract period (12 months). After the first contract period, the price may be adjusted to current list prices.

2.4 Fair Use and Resource Consumption: Hosting is included under our Fair Use Policy. In case of persistent exceeding of Fair Use limits (e.g., over 100 GB bandwidth/month or excessive server load), we reserve the right to:

• Charge additional fees for extra resources (typically 199-499 DKK/month depending on usage)
• Require upgrade to a dedicated hosting solution
• Adjust monthly price at contract renewal based on actual resource consumption

Customers are advised at least 30 days before price changes due to resource consumption take effect.

3.1 Included services: The monthly subscription price includes:

• Website hosting on Dreamstate's servers (under Fair Use terms - see Fair Use Policy)
• SSL certificate and security updates
• Up to 2 hours of maintenance and support per month
• Ongoing technical updates
• Daily website backup

3.2 Non-included services:

• Major design changes or new functionality
• Third-party licenses
• Domain registration (unless otherwise agreed)
• Email hosting
• Work beyond the included 2 hours is billed separately

4.1 Minimum commitment: All agreements have a minimum commitment of 12 months from the start date.

4.2 Termination: After the commitment period, the agreement can be terminated with 3 months' notice to the end of a month. Termination must be in writing via email.

4.3 Website transfer: Upon termination, the customer has the right to receive all files and databases upon payment of a transfer fee of 2,500 DKK excluding VAT.

5.1 Billing: Billing is done monthly in advance via automatic card payment or PBS.

5.2 Payment deadline: Payment deadline is net 8 days from invoice date.

5.3 Reminder fee: Late payment will incur a reminder fee of 100 DKK plus late payment interest according to the Interest Rate Act.

6.1 Uptime guarantee: Dreamstate strives for 99% uptime on a monthly basis, but cannot be held liable for downtime caused by:

• Planned maintenance (notified at least 48 hours in advance)
• Force majeure, including power outages, internet disruption, cyber attacks
• Errors by third-party providers

6.2 Liability for damages: Dreamstate's liability for damages is limited to direct losses and can at most amount to an amount equal to 6 months' subscription payment.

7.1 Customer content: The customer retains all rights to their own content (texts, images, logos, etc.).

7.2 Design and code: Unless otherwise agreed, Dreamstate retains the rights to all custom code and design elements developed as part of the solution. The customer acquires an unlimited usage right.

9.1 Hosting location: Data is hosted on servers within the EU to ensure compliance with GDPR.

9.2 Backup: Daily backup is stored for 30 days. Recovery beyond regular support is billed at 750 DKK per hour started.

9.3 Transfer: The agreement cannot be transferred to a third party without written consent from Dreamstate.
